Terms of Service

These Terms of Service ("Terms") govern your access to and use of the wordbeat mobile application ("App") and the website at wordbeat.co ("Website"), collectively the "Service". By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree, you are not authorized to use the Service.
1. Description of the Service
wordbeat is a language learning app that helps users build foreign language skills through vocabulary practice, grammar lessons, spaced repetition, live AI-powered conversation practice, real-time duels, weekly competitions, and group and social features. The Service is available as a mobile app and as a web app. We may update, change, suspend, or discontinue any aspect of the Service at any time, with or without notice.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 16, you must obtain verifiable parental consent before using the Service, in accordance with applicable data protection laws (e.g., EU GDPR). The Service is not intended for users under 13. Contact us at hello@wordbeat.co to provide consent or request account deletion.
You represent that you have the legal capacity to enter into a binding agreement and that you will comply with these Terms and all applicable local, national, and international laws.
3. Registration
To use the Service, you must create an account using email and password, or sign in with Google or Apple. By registering, you agree to:
- Provide accurate and complete information during registration.
- Maintain the confidentiality of your account credentials and not share them with others.
- Be responsible for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account if you provide false information, violate these Terms, or for any other reason at our discretion.
4. App functionality
4.1 Learning sessions
The App provides vocabulary practice sessions where users type translations and receive feedback. Session data, including answers, response times, and accuracy, is collected and used to power the spaced repetition algorithm and track your progress. By using the App, you consent to this data collection as described in our Privacy Policy.
4.2 AI conversation practice
The App offers a conversation feature in which you practice speaking with an AI tutor. This feature records short audio clips from your microphone during a session and processes them, together with the conversation text, using a third-party AI provider (OpenAI) to transcribe your speech and generate the tutor's responses. By using this feature, you consent to this processing as described in our Privacy Policy. AI-generated content may be inaccurate, incomplete, or unsuitable, and is provided for language practice only; it is not professional, educational, translation, or other advice, and you should not rely on it as such. You must not use the feature to submit unlawful, abusive, or infringing content, or to attempt to make the AI produce such content.
4.3 Competitive features
The App offers real-time duels and weekly competitions. Your display name, scores, and rating are visible to other users on leaderboards and in duel results. By participating, you consent to this information being displayed publicly within the App.
4.4 Social and group features
You may connect with other users, send friend requests, and challenge friends to duels. You may also join or create groups that progress through the learning path together; within a group, other members can see your progress, such as which units you have completed and when you last practiced. You may block or report users who engage in inappropriate behavior. We reserve the right to take action on reported accounts at our discretion.
5. Subscriptions and in-app purchases
The Service may offer premium features via paid subscriptions. How your subscription is billed and managed depends on where you purchased it:
- iOS: through the Apple App Store, managed by RevenueCat.
- Android: through the Google Play Store, managed by RevenueCat.
- Web: through Stripe.
5.1 Automatic renewal
Subscriptions auto-renew at the end of each billing period unless canceled before the renewal date. You manage or cancel your subscription wherever you purchased it: for App Store purchases, through your Apple account settings; for Google Play purchases, through your Google Play account settings; and for web purchases, through the Stripe billing portal accessible from the App. A subscription generally can only be managed through the store or platform on which it was purchased.
5.2 Payment processing
Payments are processed by Apple, Google, or Stripe depending on your platform, and not by us. For App Store and Google Play purchases, you agree to comply with Apple's or Google's respective terms and payment policies. For web purchases, payment is handled by Stripe under its terms. We do not receive or store your full payment card details.
5.3 Refunds
Refunds for App Store and Google Play purchases are subject to Apple's and Google's respective refund policies; we do not process those refunds directly but will cooperate to resolve issues. For web purchases made through Stripe, contact us at the address in section 19. This does not affect any mandatory statutory withdrawal or refund rights you may have (see section 15).
5.4 Account deletion and subscriptions
Deleting your wordbeat account does not automatically cancel a subscription purchased through the Apple App Store or Google Play; you must cancel those through the respective store. If you have an active web subscription billed through Stripe, deleting your account will cancel that subscription.
6. Acceptable use
You are responsible for your use of the Service and must comply with all applicable laws. You may not:
- Use the Service for any unlawful purpose.
- Attempt to manipulate leaderboards, ratings, or competition results.
- Exploit bugs or vulnerabilities in the App or its infrastructure.
- Harass, abuse, or send inappropriate content to other users.
- Attempt to reverse-engineer, decompile, or derive the source code of the App.
- Use the Service in any way that harms wordbeat or its users.
7. Privacy and data protection
Your privacy is important to us. We collect limited personal data necessary to provide the Service, including your email, display name, learning data, voice and conversation data from the AI conversation feature, and notification preferences. We do not use third-party analytics or tracking SDKs. We do not sell your data. For full details, please review our Privacy Policy.
8. Third-party services
The Service uses or integrates with the following third-party services:
- Supabase: for database hosting, backend functions, and user authentication.
- OpenAI: for the AI conversation feature (speech transcription and response generation).
- Amazon Web Services: for file storage and content delivery.
- RevenueCat: for App Store and Google Play subscription management.
- Stripe: for web subscription payment processing.
- Expo: for push notification delivery.
- Cloudflare Turnstile: for bot and abuse protection during sign-up and sign-in.
- Google and Apple Sign-In: for optional OAuth-based authentication.
We are not responsible for the operation, terms, or privacy practices of third-party services. Your use of these services is subject to their respective terms and policies.
9. License to the App
We grant you a non-transferable, non-exclusive, revocable license to download and use the App on a device you own or control, subject to these Terms. You may not:
- Derive or attempt to derive the App's source code.
- Reverse-engineer, decompile, or disassemble the App.
- Transfer the App or your license to any third party.
For Apple App Store users: these Terms are between you and wordbeat, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is a third-party beneficiary of these Terms. For Google Play users: your use of the App is also subject to the Google Play Terms of Service, and Google is not responsible for the App or its content.
10. Intellectual property
All content within the Service, including designs, text, software, vocabulary data, and the wordbeat brand, is owned by us or our licensors. You may not copy, distribute, or reproduce any part of the Service except as permitted by these Terms.
11. No warranties
The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy of vocabulary content, the availability of the Service, or error-free operation. Some jurisdictions do not allow certain warranty exclusions, so these limitations may not fully apply to you.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, profits, or business interruption. Our total liability is limited to the amount you paid for the Service in the 12 months prior to the claim. This limitation does not apply where prohibited by applicable law.
13. Indemnification
You agree to indemnify and hold harmless wordbeat, its officers, employees, and affiliates from any claims, losses, or damages (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
14. Termination
We may terminate or suspend your access to the Service at any time for any reason. You may delete your account at any time from within the App, which will permanently remove all your data. Sections 6, 9, 10, 11, 12, 13, and 18 survive termination.
15. EU/UK consumer protections
EU users have a 14-day right to withdraw from digital subscriptions per Directive 2011/83/EU, unless you expressly consent to immediate access and waive this right. UK users have similar withdrawal rights under the Consumer Rights Act 2015. Nothing in these Terms affects your statutory rights as a consumer.
16. Governing law and jurisdiction
These Terms are governed by the laws of Austria, excluding conflict of law provisions. Disputes arising from these Terms will be resolved in the courts of Vienna, Austria. For EU/UK users, mandatory consumer protection laws in your country may apply in addition.
17. Changes to these Terms
We may update these Terms at any time. Updated versions will be posted on wordbeat.co. For material changes, we will provide notice via the App or email. Continued use of the Service after changes are posted constitutes your acceptance. If you do not agree to updated Terms, you must stop using the Service.
18. Miscellaneous
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and wordbeat regarding the Service.
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.
- No waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment: We may assign these Terms without your consent. You may not assign these Terms without our prior written consent.
- Force majeure: We are not liable for failure to perform due to events beyond our control, including natural disasters, cyberattacks, third-party service outages, or government actions.
